‘Security Deposit’: Sum which is held to cover any liabilities
By signing this rental agreement, the hirer agrees that they have read, understood and accept the terms and conditions set out in this document.
1 Rental Agreement
1.1 Linskeldfield Free Range Eggs Limited trading as Cumbria Campervans hires the vehicle to the customer subject to this rental agreement. By signing a copy of this rental agreement, the hirer confirms that they have read, understood and accept the terms and conditions and will strictly comply with them.
1.2 The customer must not transfer, assign, or sublet the benefit of the agreement, or claim in any circumstance to own the vehicle or to have rights over it beyond those conferred by this agreement. The customer is permitted to use the vehicle only upon the terms and conditions of this agreement.
2 Booking and Payment
2.1 At the time of booking a 50% non-refundable, non-transferrable booking deposit is payable by bank transfer to secure the booking and the hirer will be sent email confirmation of the booking when payment has been received. The balance is payable four weeks before the first day of hire.
3 Collection & Return
3.1 Collection on the day of the hire is between 2pm and 5pm and it must be returned by 11am on the return date. If the vehicle is returned later than 11am, the hirer may be liable for extra charges in addition to any costs incurred by Cumbria Campervans as a result of the late return.
3.2 Cumbria Campervans will supply parking for one vehicle during the rental period, however, we accept no liability whatsoever for any loss or damage caused to the hirer’s vehicle and the hirer must ensure their vehicle is appropriately insured.
4 Drivers & Insurance
4.1 Only drivers named on this rental agreement may drive the hired vehicle. We reserve the right to refuse to handover the vehicle to any person deemed unsuitable and, if this is the case, all hire charges will be refunded in full and we shall have no further liability.
4.2 All drivers must be aged between 30 and 70 and have held a full UK or EU driving licence for a minimum of two years. They must have no more than six penalty points over two convictions (a maximum of three points per conviction), must not have been involved in more than one fault incident within the last three years and must not have had their licence suspended within the last three years.
4.3 When collecting the vehicle, drivers must present their valid UK or EU driving licence, two utility bills providing proof of address dated within three months of the hire date and a valid DVLA check code. The vehicle must only be driven by drivers named on this rental agreement.
4.4 The hirer will be responsible for any damage to the vehicle and third party property and is liable for the insurance excess. The hirer is fully liable for all overhead damage, damage caused by gross negligence and any repairs to windows, windscreens, wheels, tyres and contents.
4.5 Whilst the rental agreement includes insurance for damage to the vehicle and third party property, it does not include personal insurance for the hirer, passengers and does not cover loss or damage to any personal possessions. Cumbria Campervans will not be liable for any personal loss and the hirer is recommended to consider personal insurance to cover their possessions and any costs associated with early terminations of the hire due to a breakdown or accident.
5 Security Deposit
5.1 Before collection of the vehicle, customers must pay the £600-£750 refundable security deposit by bank transfer. It is the customer’s responsibility to ensure the deposit has cleared and is present in our bank account before collecting the vehicle.
5.2 The hirer agrees, accepts and irrevocably authorises that any damage claims that fall outside of the insurance terms and conditions, including the insurance excess and any penalty charges arising out of this agreement, will be deducted by Cumbria Campervans from the security deposit upon return.
5.3 This deposit is taken as security to cover damage to the van or its fixtures and fittings and any penalty charges incurred during the period of the vehicle hire. These include, but are not limited to, the following, fees which we reserve the right to retain:
Fuel refill charge: the vehicle will have a full tank of fuel upon collection and must be returned full. The cost of fuel required to refill the tank along with a £20 administration fee if not returned full.
Cleaning fee: a £90 cleaning and valeting fee if the vehicle is not deemed to be returned clean and tidy.
Late return fee: a late return fee of £40 per hour if the vehicle is returned after the agreed time.
Lost keys: the cost of replacing a lost vehicle key along with a £25 administration fee.
Traffic offence penalties: responsibility for any parking, speeding or traffic offences and toll road charges during the hire period is strictly the hirer’s liability and Cumbria Campervans does not accept any liability for fines, endorsements or court costs for such offences.
5.4 Security deposits will be refunded to the hirer within five working days of the return date and we reserve the right to retain the security deposit until such time as any estimate for the cost of repair have been obtained.
6 European Travel
6.1 The vehicle must not be taken abroad without permission from Cumbria Campervans. If permission is granted, there will be an additional fee of £10 per day in respect of extended insurance and breakdown cover.
7 Pets & Smoking
7.1 It is against the law to smoke in any vehicle hired in the UK. Smoking is strictly prohibited in the vehicle and under the awning and the additional cleaning fee will be charged if it is evident that there has been smoking in the vehicle.
7.2 Pets are permitted by prior permission. One small dog is allowed in the vehicle and an additional cleaning fee of £15 will be charged if a pet is included.
8.1 In the event of a breakdown, please call the breakdown service and notify us as soon as possible. We do not accept any liability for any costs arising from an accident, breakdown such as replacement vehicle, transport or accommodation costs. We will endeavour to assist with arranging onward travel and refund any lost hire days.
9.1 In the event of an accident you should make no admission of fault or liability or offer a settlement to other parties. You should contact Cumbria Campervans immediately and inform the police if required. You should collect names and addresses of any third parties and witnesses along with vehicles details, registration number and insurance details of any third party.
9.2 You should take photographs of the accident and any relevant evidence that could help, complete an accident report form and you must assist us in handling any arising claim. If the vehicle is left unattended, please ensure it is secure and in a safe location.
9.3 You agree to indemnify Cumbria Campervans if any third party suffers death, personal injury or damage to property caused by use of the vehicle that involves a breach by any driver of any terms and conditions of this agreement or the terms of the Cumbria Campervans’ insurance policy.
10 Provision of Campervan
10.1 Cumbria Campervans is responsible for:
Providing a VW Campervan to the hirer.
Ensuring the vehicle is maintained to a high standard and ensuring, to the best of its ability, that the vehicle is roadworthy and ready to rent at the start of the agreed hire period.
Ensuring the vehicle is fully insured and breakdown cover is provided.
Demonstrating the use of the vehicle prior to departure.
11 Hirer Responsibilities
11.1 The hirer must:
Drive the vehicle carefully in accordance with the Highway Code and the law.
Following all health and safety guidelines when operating the vehicle.
Return the vehicle at the agreed time, in a clean and tidy condition and full of fuel.
Ensure the vehicle is filled with the correct fuel.
11.2 The hirer will be responsible:
For any personal or third party losses outside the terms and conditions of the insurance policy.
For any damage caused to the vehicle during the hire period.
For the cost of replacing lost or damaged keys
11.3 The hirer must not:
Allow the vehicle to be driven by anyone other than the drivers named in the rental agreement.
Drive the vehicle while under the influence of drugs or alcohol.
Smoke in the vehicle.
Carry more than four persons in the vehicle.
Take the vehicle abroad or to festival events without permission.
Use the vehicle off road.
Overload the vehicle or load insecurely.
Take animals in the vehicle without permission.
Use the vehicle for hire or reward.
12. 1In the event of any cancellation by the hirer, the 50% booking deposit is non-refundable, non-transferrable and will be retained.
12.2 If cancellation is made up to four weeks before the start of the hire then the booking deposit will be retained. If the customer fails to pay the full cost of the booking four weeks before the start of the hire, then the booking will be cancelled and any booking deposit paid will be retained.
12.3 If cancellation is between four weeks and two weeks prior to the start of the hire then 50% of the total hire amount will be retained, if cancellation is made less than two weeks prior to the start of the hire then 100% of the total hire amount will be retained.
12.4 If the hirer is a no show and fails to collect the vehicle within the agreed times, we will assume that the hirer has cancelled the booking and no refund will be made.
12.5 If the hirer is unable to produce the required documentation or has not paid the security deposit at the point of collecting the vehicle, it will not be possible for the vehicle hire to proceed and the cancellation policy will be enforced.
12.6 In the unlikely event that, for unforeseeable reasons beyond the control of Cumbria Campervans, the vehicle is not available for hire at the agreed time then we will endeavour to supply a replacement vehicle, transfer the booking to an alternative date or refund any amounts already paid in full.
12.7 Cumbria Campervans will not be held liable and does not accept responsibility for any additional costs or compensation.
13.1 The customer acknowledges that Cumbria Campervans may terminate this agreement and repossess the vehicle at any time, without notification to the customer, and that the customer will pay any reasonable costs of repossessing the vehicle in the event that:
They are in breach of any term of this rental agreement.
They have obtained the vehicle through fraud or misrepresentation.
The vehicle appears to be abandoned.
The vehicle is not returned on the agreed date.
If we consider, on reasonable grounds, that the safety of passengers or the condition of the vehicle is endangered.
14.1 As part of the booking process we will collect personal information such as your name, email address, postal address, telephone number, driving licence information and bank account details. This information is necessary for booking and insurance purposes and to return your safety deposit. None of this information will be passed on to any third parties, other than Cumbria Campervans’s insurance company if requested.
14.2 Any information required to be held after the booking will be done so securely and in line with our GDPR policy.
